Our health and social care law team provides advice and support to public sector and independent health and social care organisations; commissioners and providers. We are a team of 29 lawyers operating out of all four of our offices. We take pride in providing high-quality support to our clients which is clear, user-friendly and responsive. The team's services include management of complex litigation in the Court of Protection, human rights, inquests, mental health, safeguarding, patient safety, serious incident response, complaints and disputes, HSE/CQC enforcement, challenges to decision-making and general clinical practice.

Rise to the Challenge

A vacancy has arisen for an individual (1-10PQE) to join our team in Bristol, Birmingham, Leeds or London. It offers the opportunity to be a part of a team with a diverse and rich practice area that's intellectually stimulating and hugely rewarding. The role will involve advising clients on a range of health and social care issues, both contentious and non-contentious. These include, but are not limited to:

  • Court of Protection or High Court Inherent Jurisdiction - regarding residence, contact, treatment and care packages - including injunctive relief.
  • Inquests - including Article 2 and jury inquests concerning physical treatment, mental health detention and treatment, community mental health and prison mental health - as well as Regulation 28/preventing future death reports.
  • Mental Health Act matters - the validity of detention decisions, s.17 leave, transfers under s.19, identification and consultation with the Nearest Relative, scope of and responsibility for s.117 aftercare services.
  • Mental Capacity Act matters - Articles 5 and 8 ECHR, capacity, best interests and deprivation of liberty.
  • Safeguarding Investigations - complex investigations under the Care Act 2014, disclosure and information sharing.
  • Judicial Review Challenges - for example concerning admission/detention, treatment and commissioning decisions.
  • Information Governance - duty of confidentiality and GDPR obligations, public interest disclosures, protecting third party data and subject access requests.
  • Complaints - investigating and responding to complex complaints as well as vexatious complainants.
  • Regulator Compliance Action - including HSE improvement notices and CQC warning notices.
  • Internal Incident Investigation - Terms of Reference, investigation and draft reports as well as potential use/impact in/on other processes and learning lessons.
  • External Investigations - such as commissioner (regional or national), professional regulator (GMC, NMC etc.), HSIB investigations and public or independent inquiries.
  • First and Upper Tier Tribunals - regarding patients both in secure settings and general acute settings.
  • Policy Review and Training - such as incident reporting and investigation, complaint management and capacity and consent policies.

Responsibilities

  • Manage your own varied caseload;
  • Advocacy at inquests, Court of Protection hearings and Tribunals;
  • Active involvement in client care and business development; and
  • Assist with the wider management and supervision of the team (as appropriate).

What we are looking for from you

  • Experience in health and social care law;
  • Advocacy experience (including preparation, attendance and representation at hearings);
  • Understanding of mental health and mental capacity law, inquests and Court of Protection;
  • Technical excellence, organised, lateral thinker with an eye for detail;
  • Enthusiasm to develop their legal skills and challenge themselves;
  • Previous successful management of existing and developing new client relationships (as appropriate);
  • Team player, with the temperament to form strong and sustained working partnerships; and
  • Practical and commercial approach.

  • Each lawyer has the opportunity to undertake pro bono legal work for local charities and not-for-profit organisations. This has seen colleagues support the Great Western Air Ambulance Charity (Bristol), St Werburgh's City Farm (Bristol) and Moseley Road Swimming Baths (Birmingham) .
