THE ROLE
Our professional discipline team is
ranked in the top tier by the legal directories and is one of the
largest in the country. We act for a significant number of
regulatory bodies, primarily in the health sector but, increasingly,
more widely across a number of professional disciplines. We are now
seeking ambitious individuals to join our London, Birmingham or
Winchester office and to help us build and develop our practice,
servicing clients both locally and nationally.
The work largely involves preparing
and presenting cases for professional disciplinary hearings, but
also requires providing advice on the scope and conduct of
disciplinary investigations, including the use of statutory powers,
and on a wide range of other issues affecting regulators.
Advocacy typically involves interim
and substantive hearings. This includes shorter more straightforward
hearings as well as more complex cases such as those involving
dishonesty and fraud, sexual misconduct and serious instances of
deficient professional performance. Hearings are usually contested
and in the majority of cases the respondents are represented, most
often by counsel. It is likely that there will also be opportunities
to appear in the High Court and the First Tier Tribunal on appeals
from decisions of the regulators. Depending on experience, there are
likely to be other advocacy opportunities arising from other aspects
of the department's work.
