About the role
We currently have an exciting opportunity for an Associate with
between 2-4 years' experience to join our Corporate Regulatory group
in Brisbane and work on financial services and corporate/commercial matters.
Our corporate regulatory team works on significant mandates for
financial services firms, corporates, digital currency firms, and a
range of other market leading institutions.
You would work with some of the most highly regarded corporate &
regulatory practitioners in the Australian market consistently ranked
at the top of the industry by the world's leading legal directories.
You will also have the opportunity to work closely with our global
corporate & advisory team which operates across the UK, Europe,
Middle East and Asia.
About you
The successful candidate will need:
Legal Expertise: The candidate must have a deep
understanding of financial services regulatory law e.g. Chapter 7 of
the Corporations Act 2001 (Cth), financial services regulations,
corporate and commercial law, contract law, and regulatory
frameworks e.g ASIC/APRA guidance.
Advice skills: You must be able to analyse complex
legal documents, and regulatory requirements to identify potential
risks and opportunities. You will need to assess the potential legal
risks associated with various financial products and services,
helping clients make informed decisions about entering specific
markets or offering certain financial instruments.
Licensing: You will assist in ASIC AFSL and AUSTRAC
DCE/remittance application processes, ensuring that clients meet the
necessary requirements and criteria for obtaining licenses and registrations.
Risk & compliance: You will help develop and
advise on compliance aspects of financial institutions to ensure
that our clients effectively adhere to regulatory requirements and
best practices. You will provide guidance on how to structure our
client's operations, products, and services to remain within the
regulatory perimeter.
Regulatory and Compliance Knowledge: The candidate
will need to stay up-to-date with relevant laws and regulations,
especially in industries where there may be specific compliance
requirements, including financial services regulation e.g. ASIC /
APRA guidance.
Corporate Governance: Knowledge of corporate
governance principles, the overlay of financial services governance
requirements e.g. the Financial Accountability Regime and compliance
with regulatory requirements is crucial. This includes advising on
board / executive matters, and stakeholder relations.
Digital assets: We also practice in emerging
financial services areas, including digital currencies. Ideally, but
not necessarily, you will have an interest in this area, or desire
to exposure your practice to this area.
Funds: experience in Superannuation, or private
funds management, is highly desirable. While not a pre-requisite, we
are looking for someone keen to expand their knowledge and skills in
this space.
Communication: Clear and effective communication is
essential, both in conveying legal advice to clients and in
negotiating with opposing parties. The candidate needs to be able to
explain complex legal concepts in a way that our clients can understand.
Investigations: When a financial institution faces
regulatory investigations or enforcement actions, you may be asked
to assist other parts of our large financial services practice in
their interactions with regulatory authorities.
Team Management: You will have experience
delegating to junior staff and be willing to help partners and
Special Counsel to manage the team and foster teamwork.
Client Management: We expect you to be comfortable
dealing directly with clients and that you will be able to build a
trusted adviser relationship. You will be expected to take an active
role in business development work.
We are open to hearing from people who have a broad regulatory,
financial services advisory and/or corporate background.
The key requirement of this role is that you have solid and
consistent experience, gained from private practice or an in-house
role. Culture is critical to our team - you need to take our clients'
trust and mandates seriously, and undertake them with our trademark
excellence, but not yourself. We do not have room for egos in our team!
You will need to demonstrate relevant experience, strong academics,
be self-driven, have excellent verbal and written communication and
time management skills, and the ability to manage competing priorities effectively.
